General Terms and Conditions (GTC)
1. Conclusion of contract and validity of the general terms and conditions and data protection
1.1. By ordering glasses or lenses according to the buyer's individual parameters from a STEINER Vision partner optician, a purchase contract is concluded between the customer and SuperVista AG that is binding on both parties and includes the following General Terms and Conditions (GTC).
1.2. Since the optical products are manufactured according to the individual parameters of the buyer and can no longer be used for any other purpose after production for SuperVista AG, there is no general right of withdrawal; the statutory provisions on the warranty for defects nevertheless apply - with the following provisions.
1.3. By providing or recording his personal data (name, address, date of birth, email address, telephone number), the buyer declares his consent to the storage and use of his data to establish, implement and terminate the desired legal obligation. He also declares his consent to the further processing of the data by way of order data processing in compliance with the statutory data protection regulations. The buyer is aware that he can query the scope and documentation of his data at any time and he can also request that his data be deleted after the legal transaction has been fully fulfilled. The buyer can object to the use of his data for the initiation of further follow-up legal transactions by SuperVista AG at any time.
2. Price information and glasses insurance
All prices quoted include the applicable sales tax and - unless otherwise stated - the tax-free glasses insurance, the premium for which is included in the quoted price and which is mandatory according to the insurer's terms and conditions. The relevant sales price for the buyer is the total price resulting from the order from the partner optician which the partner optician will be happy to break down and explain to the buyer.
3. Payments
3.1 Minimum 50% payment must be made upon ordering (applicable to any Steiner-Vision product).
3.2. The prices stated on our website and in our advertisement include VAT. The price of any product will be as quoted except in cases of obvious error. Prices are liable to change at any time, however, changes will not affect orders in respect of which we have an error. Our website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our website may be incorrectly priced. We will verify prices as part of dispatch procedures so that, where the correct price of a product is less than our stated price, we will charge the lower amount when dispatching the product to you. If the price of a product is higher than the price stated on our website, we will at our discretion, either contact you for instructions before dispatching the product, or reject your order or notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after the product has been ordered.
3.3. Payment can be made using a credit and/or debit card at a partner optician’s store, depending on the available payment possibilities at the time of order. Your card details will be encrypted to minimise the risk of authorised access or disclosure.
4. Delivery
Any delivery times given are non-binding, as minor delays cannot be ruled out due to production abroad and the transport and import of the glasses. Delivery times are constantly being optimized and shortened.
If the buyer purchases several items, SuperVista AG is entitled to deliver partial goods if the partial delivery is usable and reasonable for the buyer and can be used economically on its own.
5. Warranty, subsequent performance and compensation
5.1 The buyer's measured parameters are transferred to the German production machines digitally so that errors are virtually impossible. If the glasses are nevertheless defective within the meaning of the German Civil Code, the statutory provisions apply.
5.2. The determination of the buyer's eyesight is purely subjective and cannot be verified by the seller. The seller is therefore only liable for damages if the seller or its partner optician as a vicarious agent is at fault in determining the parameters on which the order is based.
5.3. For claims for damages due to a defect for which the Seller is responsible, which are aimed at compensation for physical injury or damage to health or which are based on gross negligence or willful intent on the part of the Seller or one of his vicarious agents, the statutory provisions shall apply.
6. Satisfaction Guarantee
As part of the satisfaction guarantee, the buyer can choose another product from Steiner Vision instead of progressive lenses within 60 days of the invoice date, such as two single-vision glasses (one each for near and far vision) or another progressive lens product. In this case, SuperVista AG is entitled to charge the buyer any difference in price; a price reduction for this replacement solution is excluded.
7. Retention of title
7.1 The purchased goods/glasses ordered remain the property of SuperVista AG until the purchase price has been paid in full, even if they have already been handed over to the buyer or purchaser and the latter has already used them - also as a necessary medical product.
7.2 If the buyer is an entrepreneur, the goods remain the property of the seller until all claims arising from the purchase contract have been paid in full, including ancillary claims (e.g. financing costs, interest, etc.). In the event that the buyer resells the goods before full payment has been made, the buyer hereby assigns to the seller all claims against third parties or the buyers in the amount of the share of the purchase price for the seller's goods.
8. Insurance
Insured, policyholder, insurer
The Insured are persons who have purchased glasses based on an effective purchase contract with SuperVista AG (hereinafter referred to as the “insured person”).
The policyholder is SuperVista AG (hereinafter referred to as the “policyholder”).
The insurer is focus Assekuradeur GmbH (hereinafter referred to as the “insurer”).
What items are insured?
We, the policyholder, offer you, the insured person, insurance coverage for the glasses from SuperVista AG (hereinafter referred to as "glasses") that you purchased from the policyholder by these terms and conditions.
Which risks and damages are insured? (Insured event)
Insurance cover exists for one year from the invoice date, at the latest from handover,
a) in the event of a difference in the insured person’s visual acuity of at least +/- 0.5 dioptres between the visual acuity determined by a doctor or an optician before purchasing the glasses and within 365 days of purchasing the glasses, or
(b) in the event of unforeseen and sudden damage to the glasses covered by this insurance. If the repair costs exceed the value of the glasses or if repairs are uneconomical.
In which cases is there no insurance coverage?
Damage is not insured, regardless of contributing causes, in the event of damage and total loss,
a) if the damage to the glasses covered by this insurance was caused intentionally by the insured person or the policyholder;
b) if the insured person fraudulently deceives or attempts to deceive the insurer about the prerequisites for an insured event;
c) which is remedied or assumed by the policyholder or glasses manufacturer as part of a guarantee or warranty;
d) due to wear and tear of the glasses covered by this insurance;
e) which is provided as part of services provided by the policyholder, such as checking the frame and lenses, checking that they fit correctly and correcting the adjustment, hygienic ultrasonic cleaning, tightening, replacing and securing screws, carefully oiling hinges;
g) due to war, civil war or warlike events, terrorism; due to nuclear energy, nuclear radiation or radioactive substances;
h) and due to loss or theft of the glasses.
When does the insurance cover begin and end?
a) The insurance cover begins on the invoice date for the glasses purchased.
If the insured person receives a replacement from the policyholder, the insurance cover expires.
b) The insurance cover ends automatically 365 days after the invoice date, but no later than
- in the event of a total loss or
- 365 days after the end of the term of the group insurance contract between the policyholder and the insurer.
The policyholder is responsible for informing you of any subsequent insurer in the event of termination of this group insurance contract; or
- in the event of the death of the insured person or
- in the event of insolvency proceedings being opened against the assets of the policyholder.
What deductible must be paid?
The insurance covers 75% of the costs incurred. In the event of an insurance claim, you will be responsible for the shipping costs incurred and 25% of the original purchase price as a deductible.
What should be observed in the event of a claim (obligations after the occurrence of the insured event)?
In the event of an insured event, please visit the STEINER-Vision partner optician yourself. You must report any damage to the STEINER-Vision partner optician at SuperVista AG immediately, but no later than one month after the occurrence of the damage. In addition, if the diopter number has deteriorated, this must be proven by a certificate from an ophthalmologist or optician. The damaged or destroyed glasses, or the glasses that have become unusable due to a change in diopter, must be handed over to the STEINER-Vision partner optician.
What are the consequences of not complying with obligations?
If a contractual obligation or a statutory obligation, the legal consequences of which are not regulated by law, is violated, you lose your insurance cover. In the event of a grossly negligent violation of an obligation, we are entitled to reduce our benefits in proportion to the severity of your fault. Both of these only apply if we have informed you of these legal consequences in a separate written notification. If you can prove that you or the policyholder did not violate the obligation through gross negligence, the insurance cover remains in place. The insurance cover also remains in place if you can prove that the violation of the obligation was not the cause of the occurrence or determination of the insured event or of the determination or extent of the benefit. This does not apply if you or the policyholder fraudulently violated the obligation.
9. Right of withdrawal
The right of cancellation does not apply to glasses whose lenses were made according to customer specifications or which are tailored to the personal needs of the buyer. The contractual satisfaction guarantee of SuperVista AG remains unaffected by this.

10. Intellectual Property Rights
You may not use any of the Intellectual Property Rights on the Website or in our products without the express written consent of steiner-vision.co.uk
11. Changes to the terms and conditions
The group reserves the right to revise and make changes to these terms and conditions of purchase from time to time to reflect changes in market conditions affecting our business, changes in technology, and/or changes in the capabilities of our system. You will be subject to the terms and conditions of purchase in force at the time that you order goods from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the email confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).
12. Jurisdiction and applicable law
The terms and conditions of the purchase and the contract shall be construed in accordance with English law. Any dispute arising from or related to the terms and conditions of purchase or the contract shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
